1. Agreement to Terms

By downloading, installing, or using the Forjum mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Matteo Balderi ("Forjum," "we," "us," or "our").

2. Description of Service

Forjum is a fitness and wellness application that:

• Transforms health data into RPG-style character statistics
• Provides adaptive minigames based on your fitness level
• Offers personalized insights about your physiological patterns
• Gamifies your health journey to encourage consistent healthy habits

The App is designed for educational and motivational purposes only.

3. Eligibility

To use Forjum, you must:

• Be at least 13 years old (or 16 in the European Union)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws

4. Account and Character Creation

4.1 Character Information

When creating a character, you may provide:

• A character name (may be fictional)
• Biological sex (used for physiological calculations)
• Date of birth or age range
• Language preference

4.2 No Account Required

Forjum operates offline-first. No email registration or cloud account is required. Your data is stored locally on your device.

5. Health and Fitness Disclaimer

5.2 Consult a Professional

Before starting any fitness program or making changes to your exercise routine, consult with a qualified healthcare provider, especially if you:

• Have any medical conditions
• Are pregnant or nursing
• Take medications
• Have been sedentary for an extended period
• Experience pain, discomfort, or unusual symptoms

5.3 Exercise at Your Own Risk

Physical exercise carries inherent risks. By using Forjum, you acknowledge that:

• You exercise at your own risk
• You are responsible for assessing your own fitness level
• You should stop exercising if you feel pain, dizziness, or discomfort
• Forjum is not liable for any injuries resulting from exercises

6. Subscriptions and Payments

6.1 Free and Premium Tiers

Forjum offers:

• Free Tier: Core features with limited access
• Premium Tier: Full access to all features

6.2 Subscription Terms

If you purchase a Premium subscription:

• Payment is charged to your Apple ID or Google Play account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's account settings

6.3 Refunds

Refund requests are handled by Apple (App Store) or Google (Play Store) according to their respective policies. We do not process refunds directly.

6.4 Beta Testers

Beta testers receive complimentary Premium access during the beta period. This access may be modified or terminated at our discretion.

7. Acceptable Use

7.1 You Agree NOT To:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any security features or access restrictions
• Use the App to harm, harass, or abuse others
• Transmit viruses, malware, or malicious code
• Interfere with the App's operation or servers
• Create derivative works based on the App

7.2 Multiplayer Features

Forjum offers multiplayer interactions through two channels:

• Local (Bluetooth): Peer-to-peer duels with nearby users. Data is exchanged directly between devices and is not transmitted to any server.
• Online (Firebase relay): Asynchronous Duels and Cooperative challenges. Only anonymous game scores and a randomly generated device ID are transmitted. Your health data is never shared.

When using any multiplayer features, you agree to:

• Behave respectfully toward other users
• Do not exploit bugs or glitches for unfair advantage
• Do not attempt to intercept, manipulate, or tamper with multiplayer data
• Report any issues or abuse to us

Multiplayer data on our servers is temporary and automatically deleted after challenge completion (maximum 7 days).

8. Intellectual Property

8.1 Our Rights

Forjum and all its contents, including but not limited to source code, visual design, graphics, animations, text, and game mechanics are owned by Matteo Balderi and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your information.

10. Third-Party Services

The App integrates with:

• Apple HealthKit (iOS)
• Google Fit (Android)
• Apple App Store / Google Play Store
• RevenueCat (subscription management)
• Firebase (analytics, crash reporting, push notifications, multiplayer relay)
• Smartwatch platforms (Apple Watch, Wear OS, Garmin)

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimers

We do not guarantee that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results from using the App will be accurate or reliable
• Any errors will be corrected

12. Limitation of Liability

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Forjum and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

14. Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the App
• Add or remove features
• Update pricing for subscriptions
• Change these Terms

We will provide reasonable notice of significant changes. Continued use after changes constitutes acceptance.

15. Termination

15.1 By You

You may stop using the App at any time by deleting it from your device.

15.2 By Us

We may terminate or suspend your access to the App for violation of these Terms, fraudulent or illegal activity, or at our discretion with reasonable notice.

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes shall be resolved through:

1. Informal Resolution: Contact us first at contacts@forjum.com We will attempt to resolve the dispute informally within 30 days.
2. Mediation: If informal resolution fails, disputes may be submitted to mediation in Zurich, Switzerland.
3. Jurisdiction: For disputes not resolved through mediation, the courts of Zurich, Switzerland shall have exclusive jurisdiction.
