1. Agreement to Terms

By downloading, installing, or using the Forjum mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Forjum App ("Forjum," "we," "us," or "our").

2. Description of Service

Forjum is a fitness and wellness application that:

• Transforms health data into RPG-style character statistics
• Provides adaptive minigames based on your fitness level
• Offers personalized insights about your physiological patterns
• Gamifies your health journey to encourage consistent healthy habits
• Offers optional online play with other users: Duels, Co-op, Avatar fights, the Help Board, Clans and Rankings

The App is designed for educational and motivational purposes only.

3. Eligibility

To use Forjum, you must:

• Be at least 13 years old (or 16 in the European Union)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws

4. Account and Character Creation

4.1 Character Information

When creating a character, you may provide:

• A character name (may be fictional)
• Biological sex (used for physiological calculations)
• Age, height and weight
• Language preference

4.2 Account (optional)

Forjum works offline-first: an anonymous profile is created automatically and no registration is needed to start. Online features and the optional cloud backup require a free sign-in with Google or Apple. You are responsible for the activity on your account. You can delete your account and your data at any time in Profile → Account → Delete Account.

5. Health and Fitness Disclaimer

5.2 Consult a Professional

Before starting any fitness program or making changes to your exercise routine, consult with a qualified healthcare provider, especially if you:

• Have any medical conditions
• Are pregnant or nursing
• Take medications
• Have been sedentary for an extended period
• Experience pain, discomfort, or unusual symptoms

5.3 Exercise at Your Own Risk

Physical exercise carries inherent risks. By using Forjum, you acknowledge that:

• You exercise at your own risk
• You are responsible for assessing your own fitness level
• You should stop exercising if you feel pain, dizziness, or discomfort
• Forjum is not liable for any injuries resulting from exercises

6. Subscriptions and Payments

6.1 Free, Supporter and Premium

Forjum offers:

• Free: the core experience, including stat progression, minigames, Avatar fights and the Help Board
• Supporter: adds online Duels and Co-op (one each every 24 hours), Clans and Rankings, the optional cloud backup and a longer stat history
• Premium: everything in Supporter, with unlimited Duels and Co-op and additional features described in the App

The current features and prices of each tier are shown in the App and on the App Store or Google Play before you buy.

6.2 Subscription Terms

If you purchase a Supporter or Premium subscription:

• Payment is charged to your Apple ID or Google Play account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's account settings

6.3 Refunds

Refund requests are handled by Apple (App Store) or Google (Play Store) according to their respective policies. We do not process refunds directly.

6.4 Virtual Items

Potions, scrolls and other in-game items are part of the game: they have no monetary value, cannot be exchanged for money and are not sold. You can receive them through gameplay, from other players, or as a benefit of a subscription. Deleting your account removes them.

6.5 Beta Testers

Beta testers receive complimentary Premium access during the beta period. This access may be modified or terminated at our discretion.

7. Acceptable Use

7.1 You Agree NOT To:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any security features or access restrictions
• Use the App to harm, harass, or abuse others
• Transmit viruses, malware, or malicious code
• Interfere with the App's operation or servers
• Create derivative works based on the App

7.2 Online Play

Online play includes Duels, Co-op, Avatar fights (live or against another player's avatar), the Help Board, Clans and Rankings. Other players can see your character name, icon, avatar stats, game results, ranking position, clan and clan messages. Your health data is never shared. What is stored and for how long is described in our Privacy Policy.

When using online features, you agree to:

• Behave respectfully toward other users
• Not exploit bugs or glitches for unfair advantage
• Not attempt to intercept, manipulate, or tamper with game data
• Report any issues or abuse to us

7.3 Names, Clans and Messages

Character names, clan names and clan messages must not be offensive, hateful, sexual, threatening, impersonating others or infringing anyone's rights. There is zero tolerance for objectionable content or abusive users. Clan messages are text and emoji; links, addresses, phone numbers and other contact details stay out of the chat, and an automatic filter blocks insults in several languages. Text messages open from age 16, the age in your profile; younger players chat with emoji.

You can report a message or a clan from inside the App or by writing to us, and block a player so their messages disappear from your phone. The founder, the vice and the moderators of a clan can delete messages, mute members and ban members of their own clan; a player banned from a clan leaves it and can join another clan after 24 hours. When a founder leaves or stays away for 30 days, the member with the most points of the last four weeks becomes founder. Members who don't open the App for 32 days leave their clan automatically, after a reminder two days before; a clan left without members is deleted. We review reports about founders, vices and moderators and any report left unanswered for 24 hours. We may remove content, rename or remove clans, ban a player from all clan chats and clans for 48 hours, and suspend or terminate accounts that break these rules, normally within 24 hours of a report. You can leave a clan at any time.

8. Intellectual Property

8.1 Our Rights

Forjum and all its contents, including but not limited to source code, visual design, graphics, animations, text, and game mechanics are owned by Forjum App and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your information.

10. Third-Party Services

The App integrates with:

• Apple HealthKit (iOS)
• Health Connect (Android)
• Apple App Store / Google Play Store
• RevenueCat (subscription management)
• Firebase (sign-in, online play, cloud backup, analytics, crash reporting, push notifications)
• Smartwatch platforms (Apple Watch, Wear OS)

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimers

We do not guarantee that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results from using the App will be accurate or reliable
• Any errors will be corrected

12. Limitation of Liability

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Forjum and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

14. Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the App
• Add or remove features
• Update pricing for subscriptions
• Change these Terms

We will provide reasonable notice of significant changes. Continued use after changes constitutes acceptance.

15. Termination

15.1 By You

You may stop using the App at any time. To delete your data on our servers as well, use Profile → Account → Delete Account before removing the App from your device.

15.2 By Us

We may terminate or suspend your access to the App for violation of these Terms, fraudulent or illegal activity, or at our discretion with reasonable notice.

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes shall be resolved through:

1. Informal Resolution: Contact us first at forjumapp@gmail.com We will attempt to resolve the dispute informally within 30 days.
2. Mediation: If informal resolution fails, disputes may be submitted to mediation in Zurich, Switzerland.
3. Jurisdiction: For disputes not resolved through mediation, the courts of Zurich, Switzerland shall have exclusive jurisdiction.
